This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of the terms and conditions. Unauthorised use of this website may give claim for damages and/or be a criminal offence.
A Blank Canvas Design is committed to protecting your privacy and implements strict security measures. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998), which can be found at Privacy Policy. By using this website, you consent to the processing described therein and warrant that all data provided by you is accurate.
You must not misuse this website. You will not commit or encourage a criminal offence; transmit or distribute a virus, Trojan, worm, logic bomb or any other material which is malicious, technically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the service; corrupt material, commonly referred to as ‘spam’; or attempt to affect the performance or functionality of any computer facilities of or accessed through this website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. A Blank Canvas Design will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your misuse of this website.
Copyright and Intellectual Property Rights remain with the artist (or other Copyright owner) even after you buy the original Artwork, Limited Edition Print or product. Purchase of any Artwork or products from A Blank Canvas Design does not grant you any right other than that of ownership of the Artwork or Products. You are not permitted to publish, modify, decompile or otherwise reproduce, in any format, any of the content or copies of the content supplied to you, or which appears on this website, nor may you use any such content in connection with any business or commercial enterprise. The creator of the Artwork (the “Artist”) reserves all rights protected under the United Kingdom Copyright Law in all Artwork and/or products purchased by the customer.
Our Contract
By placing an order for the purchase of Artwork, Products and/or services you are offering to purchase a product on the following terms and conditions and shall be regarded to constitute an action by the user (the “customer”) to enter into a contract on these terms and conditions. All orders are subject to availability and confirmation of the order price. All of A Blank Canvas Designs prices are in UK Pounds. Payment is specified on the site page for each Artwork, Product or Service.
Pricing
All prices quoted on this website are accurate at the time of publication and are quoted in pounds Sterling (£) and where appropriate are inclusive of UK tax (VAT) at the current rate. Delivery to UK only. Delivery costs will be included for all Artwork, Canvases and Products, but charged in addition to our Furniture and Accessories outside a 30 mile radius from our studio; such additional charges are displayed below. This will not include customs duties, export or import charges. Full payment will be required at time of order prior to your items shipment. We accept online payment in a secure environment via PayPal. Once the order is processed by us, we will email you back to confirm the order.
Cancellations and Refund Policy
Under the United Kingdom's Distance Selling Regulations you have the right to cancel any order made from A Blank Canvas Design except when a bespoke item has been ordered. Any cancellations must be confirmed in writing within 24 hours of the order being placed. You must email your name, address and order number to sales@ablankcanvasdesign.com within 24 hours of placing the order. Upon receipt of your email we will cancel the order and reply to you confirming that your order has been cancelled. If we have already dispatched your item then you (the “customer”) will incur the cost of returning the item to us. Once this has been returned to A Blank Canvas Design, we will issue you with a refund.
Delivery
A Blank Canvas Design will organise delivery of your Artwork and/or products to the customer by courier to the address specified on the order page. The courier, Artist and/or A Blank Canvas Design will pack and insure the Artwork and/or products for the full purchase price. A Blank Canvas Design will advise the customer of delivery lead times at the time of order confirmation. This is usually a maximum of 2 weeks for Artwork and/or products subject to availability, however for bespoke items and furniture this can take up to 8 weeks.
Upon receipt of your goods, you are required to check and provide a signature to verify the condition of your goods. Any damages or defects should be reported immediately, and within 24 hours of receiving goods, via telephone. This does not affect your consumer statutory rights. A Blank Canvas Design will endeavour to deliver throughout the UK, and charges are dependant on the customers location. If you wish to purchase an item for delivery outside the UK please contact us to discuss your requirements.
We are unable to agree specific days and times with your order, however we will aim to arrange a delivery date to best suit your requirements. In accordance with the Sale of Goods Act 1979, it is the customers responsibility to ensure that large items will fit into the home, and that there is sufficient access for delivery of goods. We cannot be held responsible for any product that does not fit into the room or desired place, nor will refunds be offered in this instance. All sizes of our products are clearly indicated on the website, so please check before purchasing.
Our furniture delivery service includes delivery of the furniture to your home. Due to Health and Safety we are unable to carry furniture upstairs. We will not attempt deliveries where damage to your property may occur, nor will we remove doors or windows.
We charge £40.00 for deliveries within a 40 mile radius of our studio, and £50.00 for deliveries within a 50 mile radius. Please allow up to 8 weeks for delivery.
For deliveries further afield, we charge on an individual basis. Please contact us to discuss your order.
The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law A Blank Canvas Design and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this website or the linked sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect A Blank Canvas Designs liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
All of our Artwork and/or products displayed on the site are offered on a first-come, first-served basis. There may be an instance when a customer purchases goods that are no longer available. Although this is unlikely, A Blank Canvas Design does not guarantee the availability for the purchases of any Artwork and/or products displayed on the site. We take every care to ensure that the description and specification of our products are correct at the time of publication. The colour reproduction of the products is a close representation and we can therefore not be held responsible for any variation in colour caused by the browser software used by you. It is also important to note that there may be minor inaccuracies in dimensions and specifications especially with our furniture and accessories.
Except where expressly stated to the contrary all persons (including their names and images), third party trade marks and images of third party products, services and/or locations featured on this website are in no way associated, linked or affiliated with A Blank Canvas Design and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this website are owned by the respective trade mark owners. Where a trade mark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to A Blank Canvas Design.
You agree to indemnify, defend and hold harmless A Blank Canvas Design, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this website or your breach of the Terms of Service.
A Blank Canvas Design shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the services and/or any page of this website.
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected and all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
